This Cancellations & Refunds Policy (the Policy ),
dated as of the Effective Date provided above, constitutes a legally binding
agreement made between Seattle Pride Hockey Association, Inc. ( SPHA )
and you (the Participant ) and governs cancellations and refunds for
all events, programs, leagues, and tournaments offered by SPHA, and the
purchase of merchandise and products sold by SPHA. SPHA and Participant are
each a Party and together, the Parties. The Parties hereby
agree to be bound by this Policy. Please note that the Policy below does not apply
to sales, promotions, trial periods, or other offers SPHA may designate from
time to time.

1.1.
SPHA offers the following programs (not all of which may be
listed): Pride Skate, Seattle Pride Hockey Training, Pride Current Watch Party,
Pride Tape with a Pro (collectively, the Programs ).
1.2.
The Programs take place on dates designated by SPHA.
1.3.
Other than expressly set forth in this Section 1, SPHA does not offer
Participants any Credits, Refunds, carryovers, or the like for Participants
that no-show, miss a date, become injured, are suspended by SPHA or by any
neighboring organization within the Washington State, or are ejected from SPHA
for misconduct or other behavior.
1.4.
If SPHA or the hosting facility cancels a Program, SPHA will
offer Participant a credit to Participant s mySPHA account (a Credit )
or, at Participant s written request, a pro rata refund (a Refund ),
where such Credit or Refund is equal to the amount the Participant paid for the
cancelled Program.
1.5.
Participant may cancel their registration for a Program in one of the
following ways:
1.5.1.
By providing written notice at least thirty (30) calendar days
prior to the applicable Program start date, in which case SPHA will provide a 100%
Credit, or at Participant s request, a 90% Refund, equal to the amount
Participant paid for the cancelled Program.
1.5.2.
Subject to Section 1.5.2.1, by providing written
notice at least fifteen (15) calendar days prior to the applicable Program
start date, in which case SPHA will provide a pro-rata 50% Credit, or at
Participant s request, a Refund, equal to 40% of the amount Participant paid
for the Program.
1.6.
Notwithstanding anything to the contrary in this Section 1, no Credits or Refunds
will be granted beginning fourteen (14) calendar days prior to the start date
of the applicable Program. The registration payment will be retained in full by
SPHA as a cancellation fee.
2.
TOURNAMENTS
2.1.
SPHA currently offers the following tournaments (not all of
which may be listed): Seattle Pride Classic, Frozen Pride Classic, Rain City
Rush, and several associated functions (collectively, the Tournaments ).
2.2.
Tournaments may be either free agent, individual-based
tournaments (e.g., Seattle Pride Classic, or Free Agent Tournaments )
or team-based tournaments (e.g., Frozen Pride Classic, Rain City Rush, or Team
Tournaments ).
2.3. Free Agent Tournaments
2.3.1.
Other than expressly set forth in this Section 2.3, SPHA does
not offer Participants any Credits, Refunds, carryovers, or the like for
Participants that no-show, miss a date(s), become injured, are suspended by
SPHA and/or any neighboring organization within Washington State, or are
ejected from SPHA for misconduct or other behavior.
2.3.2.
If SPHA or the hosting facility cancels a Free Agent Tournament,
SPHA will offer Participant a Credit or, at Participant s written request, a
pro rata Refund, where such Credit or Refund is equal to the amount the
Participant paid for the cancelled Free Agent Tournament.
2.3.3.
If there is a Replacement Participant available to assume
Participant s spot in the Free Agent Tournament, Participant may cancel their
registration for the Free Agent Tournament in one of the following ways:
2.3.3.1.
By providing written notice at least sixty (60) calendar days
prior to the applicable Free Agent Tournament start date, in which case SPHA
will provide a full Credit, or at Participant s request, a 90% Refund, equal to
the amount Participant paid for the cancelled Free Agent Tournament
2.3.3.2.
By providing written notice at least fifty-nine (59) calendar
days prior to the applicable Free Agent Tournament start date and up to thirty-one
(31) calendar days prior to the applicable Free Agent Tournament start date, in
which case SPHA will provide a pro-rata 50% Credit, or at Participant s request,
a Refund, equal to 40% of the amount Participant paid for the cancelled Free
Agent Tournament. SPHA will retain the other 50% or 60%, respectively, as a
cancellation fee.
2.3.3.3.
Notwithstanding anything to the contrary in Section 2.3, no Credits or Refunds
will be granted beginning thirty (30) calendar days prior to the start date of
the applicable Free Agent Tournament, even if a Replacement Participant is
available. The registration payment will be retained in full by SPHA as a
cancellation fee.
2.3.3.4.
For purposes of the Policy, Replacement Participant means (i) an individual that, on the cancellation date, is on a
waitlist maintained by SPHA for the Tournament and such individual agrees to
assume Participant s place in the Tournament, or (ii) an individual identified
by Participant that is available to assume Participant s spot in the Tournament.
An individual s status as a Replacement Participant is subject to SPHA s
approval, which will be granted in SPHA s sole discretion. For the avoidance of
doubt, if no Replacement Participants are available for the applicable Tournament,
Participant will not be entitled to a Credit nor Refund.
2.4.1.
Registration (excluding any team and player deposits) for any
Team Tournament becomes fully non-refundable at time of registration,
regardless of reason. All sales are final.
2.4.2.
Other than expressly set forth in this Section 2.4, SPHA does not offer
Participants any Credits, Refunds, carryovers, or the like for Participants
that no-show, miss a date, become injured, are suspended by SPHA and/or any
neighboring organization within the State of Washington, or are ejected from
SPHA for misconduct or other behavior.
2.4.3.
If SPHA or the hosting facility cancels a Team Tournament, SPHA
will offer Participant a Credit or, at Participant s written request, a pro
rata Refund, where such Credit or Refund is equal to the amount the Participant
paid for the cancelled Team Tournament.
2.4.4.
For the avoidance of doubt, no Credits or Refunds will be
granted for Team Tournament deposits after Participant s team is accepted to
the Team Tournament, including even if there is a team that could assume
Participant s withdrawing team s place in the applicable Team Tournament. The
deposit payment, and any Participant payments made towards that team, if
applicable, will be retained in full by SPHA as a cancellation fee.
2.4.5.
Once a Participant registers and submits payment to their team
for a Team Tournament, there will be no Credit or Refund available, even if
there is another Participant available to assume Participant s place. All
sales are final. We encourage Participant s to work with their
respective Team Captain on options.
2.4.6.
For Rain City Rush or any situation where SPHA sends a team to
another city, once a Participant registers and submits a deposit and/or payment,
there will be no Credit or Refund available, even if there is another
Participant available to assume Participant s place. All sales are final.
3.1.
Registration for Seattle Pride Hockey League ( League )
becomes fully non-refundable at time of registration, regardless of
reason. All sales are final.
3.2.
Other than expressly set forth in this Section 3, SPHA does not offer
Participants any Credits, Refunds, carryovers, or the like for Participants
that no-show, cancel, miss any League games, become injured, are suspended by the
League and/or any neighboring league within the State of Washington, or are
ejected from the League for misconduct or other behavior.
3.3.
If SPHA cancels one or more games in the applicable season, then
SPHA, in its sole discretion, will offer Participant: (a) a Credit equal to the
amount the Participant paid for the cancelled game(s), or (b) make up games at
the end of the season, and/or (c) provide a scrimmage in lieu of an actual game.
If a makeup game is scheduled, SPHA is not obligated to provide any Credit or
Refunds for absent Participants, provided SPHA provides at least seven (7)
calendar days notice to Participants.
3.4.
When Participant initially enters the League, Participant will
pay a jersey and socks deposit as stipulated by SPHA (the Uniform Deposit ).
Once the season concludes, and all items are returned (one (1) jersey and one
(1) pair of socks) in a fair and reasonable condition, the
Uniform Deposit will be credited to the Participant s mySPHA Account for use
towards the next season. Participant may request a Refund of the Uniform
Deposit up to thirty (30) calendar days after completion of the applicable League
season.
4.
PRODUCTS (MERCHANDISE, APPAREL, TICKETS)
4.1.
SPHA may offer merchandise (including apparel and namebars),
event admission tickets, raffle tickets, and similar items (collectively, Products ).
4.2.
All Products purchased directly from SPHA, whether online or in
person, are non-refundable and non-exchangeable, except in cases of
manufacturing defects, customization errors (if applicable), or gross
negligence on the part of SPHA that results in an event failing to take place
as reasonably promised. Determinations of refund eligibility due to gross
negligence are at SPHA s sole discretion. All other sales are final.
4.3.
This Policy applies only to Products purchased directly from
SPHA. For any Products obtained through third-party retailers or vendors, selling
Products on SPHA s behalf, Participants must follow that retailer s return and
refund policies.
5.
DONATIONS
5.1.
SPHA is a registered nonprofit organization (Tax ID # 84-3717428).
All donations made to SPHA whether one-time or recurring are non-refundable,
unless the donation was made in error (e.g., duplicate transaction), in which
case the donor must contact SPHA within fifteen (15) calendar days of the
donation date to request a correction or Refund.
5.2.
Refund requests within fifteen (15) calendar days will be
considered on a case-by-case basis and must be submitted in writing to
Hello@SeattlePrideHockey.org. SPHA reserves the right to refuse a Refund that
does not meet the criteria above or if the funds have already been used in
accordance with our mission. Refund requests outside the fifteen (15) day
threshold require a review by the board of directors at the next scheduled
meeting.
5.3.
Donors are encouraged to consult with a tax professional
regarding the deductibility of their contribution. SPHA will provide donation
receipts for all qualifying contributions upon request.
6.
ISSUING OF CREDITS OR REFUNDS
6.1.
If SPHA grants Participant a Refund pursuant to this Policy, SPHA
will issue Refunds to the original payment method where possible, or via check
if necessary. If SPHA grants Participant a Credit pursuant to this Policy, such
Credit will be added to Participant s mySPHA Account where it will be
eligible for use within one calendar year (365 calendar days) from the day SPHA
grants such Credit. If Participant does not use the Credit within one calendar
year (365 calendar days), then the Credit expires, and Participant may not seek
further Credits or Refunds. Participants may view the number of days remaining
until the applicable Credit expires through the Participant s mySPHA Account via
their Dashboard. SPHA is not obliged to provide electronic and/or written
communications of upcoming expiration dates, except as applicable by local law.
For purposes of this Policy, a Refund means the return of
funds paid by Participant to SPHA back to the original payment method (or by
check, if necessary). A Credit means funds retained by SPHA and issued to
Participant s mySPHA Account for use toward eligible future SPHA registrations;
unless otherwise stated, Credits may be applied only to Programs, Tournaments,
and League registrations and may not be used to purchase Products or make
Donations.
7.
FORCE MAJEURE
7.1.
SPHA shall not be responsible for any Credits, Refunds, or
make-up events resulting from cancellations, postponements, or interruptions
due to events beyond its reasonable control, including but not limited to
extreme weather (snow), facility closures, equipment failure, labor shortages,
governmental mandates, public health crises (e.g., COVID-19 or similar),
natural disasters, acts of war or terrorism, or other events commonly referred
to as acts of God. In such instances, all fees paid shall be retained by
SPHA, and no additional compensation shall be owed to the Participant.
8.
ADDITIONAL POLICIES
8.1.
Participant s participation in Programs, Tournaments, and/or the
League is subject to the rules, policies, and additional terms and conditions
available on SPHA s website ( SPHA Terms ), including the Participant Conduct Policy, Privacy Statement, Terms & Conditions, Inclusion in Hockey
Statement,
and any program-specific policies/rules (i.e., Tournament Rules & Game
Formats, League Guidelines & Supplemental Rules, Player Discipline Guidance,
etc.) that SPHA may provide to Participant from time to time. Participants are
expected to review all applicable SPHA Terms prior to registering, and/or
making any purchases or participating in any Programs, Tournaments, and/or Leagues
hosted or organized by SPHA.
8.2.
Participants are strongly encouraged to consider purchasing
registration insurance at the time of registration. Registration
insurance powered by Vertical Insure may cover unexpected circumstances that
prevent participation, such as injury, illness, or travel disruption. SPHA is
not responsible for reimbursing Participants for cancellations outside of the
refund windows set forth in this Policy, including force majeure-related
events. All claims and reimbursement requests related to registration insurance
must be directed to the insurance provider and are subject to their respective
terms and conditions.
9.
RIGHT TO MODIFY
9.1.
SPHA reserves the right to amend this Policy at any time.
Updated versions will be posted to our website and take effect upon
publication. These updates will apply only to registrations and purchases made
on or after the published Effective Date. For all registrations and purchases
made prior to the Effective Date, the version of the Cancellation & Refunds
Policy in effect at the time of the transaction will apply. Participants are
encouraged to review the latest version of the Policy prior to registering or
making any purchases.
YOU ARE ACCEPTING THIS POLICY EITHER BY CLICKING A BOX
INDICATING ACCEPTANCE, COMPLETING REGISTRATION, OR OTHERWISE PARTICIPATING AND
